Activ.run Mobile Application Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Activ.run mobile fitness application (the "App") provided by Activ.run ("Company," "we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms and by our Privacy Policy.
1. Eligibility and acceptance
By using the App, you represent and warrant that you are at least 18 years of age, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into these Terms. If you are under 18, you may use the App only with the consent of your parent or legal guardian.
2. User accounts
You must register an account to access most features of the App. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You may request to delete your account at any time within the App's Profile menu. Upon deletion, we will remove associated personal data and workout history, subject to data retention and legal compliance obligations.
3. Use of the App and health disclaimer
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to your compliance with these Terms.
The App provides workout tracking, exercise recommendations, and fitness data analysis for informational purposes only. It is not a substitute for professional medical or fitness advice, diagnosis, or treatment. You use fitness programs, exercises, and information provided by the App at your own risk and should consult a qualified health professional before starting a new fitness program.
Health Connect (Android)
If you choose to connect your Android device's Health Connect account, you grant activ.run permission to read health data from Health Connect as described in our Privacy Policy. You may revoke this permission at any time through Android settings or through the Health Connect app. activ.run's access to Health Connect data is governed by the Health Connect Permissions Policy and applicable Google platform terms.
You agree not to use the App for illegal purposes, disrupt the App or its systems, attempt unauthorized access, bypass token-based authentication, or transmit viruses or destructive items.
4. Intellectual property and user content
The App, including software code, visual interfaces, graphics, design, information, data, services, and related elements, is owned by Activ.run or its licensors and protected by copyright and other intellectual property laws.
You retain rights to workout logs, bodyweight entries, and other content you submit. You grant Activ.run a license to use that content solely to provide, maintain, and improve the App and its services.
5. Third-party services
The App may rely on third-party services, including PostHog for product analytics and Sentry for error and crash monitoring. Your use of the App may also be subject to those providers' terms and privacy policies.
6. Subscriptions and fees
If the App or any features require a paid subscription, you agree to pay applicable fees and taxes. Subscriptions are typically billed through the relevant platform, such as Apple App Store or Google Play Store. Purchases are generally final and non-refundable except as required by law or applicable app store terms.
7. Termination
We may terminate or suspend your account and access to the App if you breach these Terms. Provisions that should survive termination, including ownership, warranty disclaimers, indemnity, and limitations of liability, will survive.
8. Disclaimer of warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Activ.run disclaims all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, Activ.run and its affiliates, directors, employees, and licensors will not be liable for indirect, punitive, incidental, special, consequential, or exemplary damages arising from your use of, or inability to use, the App.
10. Governing law and dispute resolution
These Terms are governed by the laws of the applicable jurisdiction for Activ.run, without regard to conflict of law provisions. Any legal action or proceeding arising from these Terms will be brought in the appropriate courts for that jurisdiction.
11. Changes to the Terms
We may modify these Terms at any time. If we make material changes, we will notify you through the App, email, or other reasonable means. Continued use after changes become effective means you agree to the revised Terms.
